Partition Action

What is a Partition Action in Florida?

A partition action is a court process used to divide or force the sale of jointly
owned property when the owners cannot agree on what to do with it.

Florida law allows for property to be owned jointly by multiple individuals or entities, which can sometimes lead to disagreements. These disagreements may pertain to the management, use, or sale of the property, and when such conflicts cannot be amicably resolved, a Partition Lawsuit becomes a vital legal tool.

A Partition Action is essentially a request made by one of the joint owners to the court, asking it to intervene and order the sale of the property. This legal process is used when all parties cannot reach an agreement on what to do with the property, especially when one or more owners do not wish to sell their share.

There are several reasons why a partition of property might be necessary. Common scenarios include:

  • Inherited Property: When adult children inherit a home from a deceased parent and become joint owners as Tenants in Common. This often happens when the property is left to multiple heirs, and they cannot agree on whether to keep or sell the property.

  • Unmarried Couples: When an unmarried couple purchases property together as Joint Tenants with Right of Survivorship and later decides to break up. In such cases, they might not agree on the property’s future, necessitating a Partition Action.

  • Investor Disagreements: When two or more investors purchase an investment or rental property as Tenants in Common and later decide to part ways. Disagreements about the management or disposition of the property can lead one party to seek a partition.
