Florida does not legally require an attorney at a real estate closing, but having one protects you in ways that a title company or real estate agent cannot. Attorneys can review contracts, catch legal issues before they become expensive problems, and represent your interests specifically, not the transaction's interests generally.
A title search examines the public record history of a property to identify any liens, judgments, unpaid taxes, easements, encroachments, competing claims, or other defects that could affect your ownership. Issues found in a title search must be resolved before a clean transfer of title can occur.
Key provisions include rent escalation clauses, CAM (common area maintenance) charges, personal guarantee requirements, renewal options, permitted use language, build-out responsibilities, assignment and subletting rights, and exit clauses. A lease that looks straightforward can contain terms that significantly shift risk to the tenant. We review every clause before you sign.
A warranty deed guarantees that the seller holds clear title and will defend against future claims. A quitclaim deed transfers whatever interest the grantor has without any guarantees. Quitclaim deeds are commonly used between family members or to clear title issues, but they offer no protection to the buyer if problems arise later.
